We are importer of Raw wool China and are importing since 8-9 years. We imported 110 bales Gross Weight 25446 kgs of Raw wool Xushui Baolai Woollen Product Co. Ltd, Xushui y, Baoding, Hebei Province, China in October,2007. Upon receipt of the goods at the Nhava Sheva port, we found that 57 bales were damaged one side due to water in the container. We filed the complained with the PICC agent in India. They carried the survey and calculated the damage loss. But the Indian agency sent a letter that the Insurers i.e. "PICC have rejected the claim by saying that the alleged loss in this case has been caused by poor condition of the container. As the consignement was shipped on " Shipper''s load, & seal" basis the alleged loss/damage negligence of the Shippers, Insureres liability is not involved. So, they refused the claim. We even gave them a letter the shipper about the condition of the container, where the shipper said that the container condition was good. We contacted the supplier, he said that he has insured the goods and we must contact the Insurer. It has been more than 2 years and our loss is of USD3350/-. We even contacted the PICC, china branch by email, but didn''t receive any reply. So, please let us know what to be done to get the claim. We shall be very thankfull to you. Dear Sirs, I decided to ress to you with a question. May be you may help me. To describe the situation in short: our company is located in Russia. We concluded a contract with a Chinese company on supply of TV-antennas, F-connectors and another positions. Before shipment the Chinese part sent us the samples of F-connectors and they were fine, but when the goods came to Russia it occured that TV antennas were damaged and F-connectors didn''t correspond to the samples. Firstly that Chinese company said that they will change the F-connectors and take all the delivery expenses, but now they fired the manager with whome we worked and made out two conditions that were not permittable for us. And they don''t want to make a compromise at all, we prosed them two variants to decide that situation. Koreadeal say this cost is down to me and the goods will not be shipped until i pay the 50%.
